1. Terms of Use

IZITrax.com reserves the right to modify or renew the articles of this agreement and the terms of transactions herein described in all details, according to IZITrax.com's needs and transaction ethics.IZITrax.com is obliged to notify users for such changes through the pages of this website.

2. Information & products

IZITrax.com is in charge of the quality, reliability and fullness of the information and products appearing in IZITrax.com, reserving the right to any amendements due to misprints or hosting server's errors.

3. Limited Responsibility

IZITrax.com cannot be held responsible against damages of clients/users because of the realization or not of their orders, except in case described in article 11 of this agreement. IZITrax.com cannot be held responsible for delivery times in cases of urgent needs (strikes, natural phenomena).

4. Copyrights

Names, pictures, photographs, logos and the whole content appearing in IZITrax.com are owned by prominence recordings LTD. and/or IZITrax.com and/or third-party partners for use only in this website, they are copyrighted and protected as described in the related international laws. Any use of part or the whole content without prior written permission by IZITrax.com consists copyright infrigement.

5. Limited License for Digital Downloads

Upon receipt of payment IZITrax.com shall grant to you a limited, non-transferable, personal, conditional license to your personal use of each downloadable digital file containing any content (Download(s)) subject to the terms and conditions of this agreement.

5α. Permitted Uses of Digital Downloads

Under this limited license you shall have the right to copy or transfer the relevant digital file to any desktop computer, laptop computer, or playback device owned by you, and/or to a recordable medium (such as CD-R or DVD-R) for your personal use without restriction but subject at all times to the fair use provisions of the european and international copyright laws. Notwithstanding anything to the contrary stated elsewhere in this Agreement, you shall be entitled to publicly perform Downloads as part of DJ performances provided that you shall submit the playlist information for any use of the Downloads as part of such DJ performances to the relevant performing rights society(ies) as required under applicable laws. For the avoidance of doubt, IZITrax.com shall not be responsible for payment of public performance royalties or phonographic performance royalties to the relevant society(ies) with respect to your use of Downloads and you hereby expressly agree to indemnify us against any third party claims arising in connection with your use of Downloads as part of DJ performances.

5b. The permitted uses as stated above with respect to each Download shall also apply to any audio-visual files, label copy, description, artwork, logos and any other materials associated with the relevant Download ("Metadata").

5c. The territories in which Downloads are available for a particular Title or Track vary from record label to record label, from Title to Title and from Track to Track. The permitted uses apply only in those territories specified next to the download button for each Title or Track.

5d. No other transfers, copies or uses of the Downloads, materials or audio samples are permitted. All other rights are hereby expressly reserved.

6. Prohibited Uses of Digital Downloads

The limited license granted by IZITrax.com to you for your personal use of each Download and any Content or Metadata shall be subject to the following restrictions which you hereby expressly agree to comply with at all times as follows:

6a. You shall not copy or transfer the relevant Download or any Content or Metadata to any desktop computer, laptop computer, or playback device not owned or regularly used by you

6b. You shall not copy or transfer the relevant Download or any Content or Metadata to a recordable medium (such as CD-R, DVD-R) which you distribute or sell to any third party  

6c. You shall not transmit the relevant Download or any Content or Metadata to any third party via the internet or otherwise

6d. You shall not upload the relevant Download or any Content or Metadata to any website or other medium accessible by any third party via the internet or otherwise and you hereby expressly agree not to make the rel evan t digital file available to any third party through so-called "file sharing" services 

6e. You shall not bundle or compile Downloads or any Content or Metadata for distribution or sale of bundled or compiled Downloads or any Content or Metadata to any third party; you shall not incorporate, interpolate, sample or combine with other copyrightable material any portion of the Downloads or any Content or Metadata to create new musical or audio-visual works 

6f. You shall not incorporate, interpolate, edit, alter, sample or combine with other copyrightable material any portion of the Downloads or any Content or Metadata to create any derivative works 

6g. You shall not engage in any unauthorized commercial use of the Downloads or other relevant digital files or any Content or Metadata without express prior written permission to do so. For the avoidance of confusion, this shall not affect your ability to use the Downloads in connection with professional DJ equipment and the like or the use of Downloads by DJ's as part of their DJ sets subject to the DJ's compliance with all applicable reporting requirements as set forth in Paragraph 5a above .  

6h. You shall not reverse engineer, decompile, disassemble, modify or disable any watermarking or copy protection or use limitation features or software which may be contained in the Downloads or other relevant digital files. 

7. Except as expressly stated above as a Permitted Use under this agreement, all other non-enumerated uses of the relevant digital file are prohibited and shall constitute a violation of our terms of use. You hereby agree to indemnify and hold harmless IZITrax.com for any damage or expense incurred, resulting from any failure by you to comply with the provision of this section of the agreement.
WARNING: IZITrax.com uses patented third-party watermarking technology. Any Downloads which are subsequently uploaded or fileshared by you will be indelibly watermarked with the original user's IP address and other information. This information will be made accessible to the authorities upon request so as to support the ongoing efforts to discourage copyright infringement.

8. User's responsibility

IZITrax.com users agree that they won't be using IZITrax.com for sending, publishing, emailing or transmiting by any mean any content that can be identified as illegal, harmful, threatening, assaulting, annoying, detractoring, explicit, racial, classified information, spyware, malware and/or copyright infringement.

9. Security

IZITrax.com is totally aware and fully respects the importance of privacy.

All personal and transaction information is safe and classified by the following means:

The username and password you are using for logging-in in IZITrax.com guarantee maximum safety for your personal data. We suggest you change often your password and in case you have a leak of your login info you should contact us as soon as possible.

11. Returns - Refunding

In case we deliver wrong order or damaged product you have the right to return them within 20 days and we will take care of you getting what you ordered in excellent condition as soon as possible and at our expense!
Please, be sure to notify us by email (cs@izitrax.com) before you return, your returns to be intact (exactly in the same condition they were received) and to include the receipt or the delivery note-invoice.

12. Payment Options

Credit or debit card (Visa, Mastercard). We offer secure transactions encrypted in SSL-128 bit and verified by Verisign.
For physical products' order, your card will be charged upon its shipment.
For digital products' or physical and digital products' order (mixed shopping cart), your credit card will be charged upon your order's confirmation.

13. Order Confirmation

Upon completing your online order you will receive an order confirmation email including delivery cost. You can modify or cancel your order within 3 hrs upon the receipt of its confirmation.All orders received weekdays before 5pm CET are processed and dispatched the same day.

14. Delivery Time

All orders received until 5pm CET are processed and sent out the same day.
For anywhere in Europe it will take 2-4 working days for your order to be delivered. For the rest of the world 3-8 working days.
In case you haven't received your order within 15 days after the confirmation email receipt please notify us by sending us an email in: cs@izitrax.com and we will refund or replace your order.

15. Delivery cost/ Free shipping

For cd or 7" single, there will be an additional 1,80-2,20€ charge on your order depending on where your order will be delivered (Europe or elsewhere) plus 0,40-1,00€ for each additional item.
For 12" vinyl extra charge is 2,30-2,80€ depending on where your order will be delivered (Europe or elsewhere) plus 0,70-1,30€ for each additional item.
All shipments above 45€ for Greece, 60€ for anywhere in Europe and 85€ for anywhere in the rest of the world, are not subject to delivery fees (free shipment).
